Why Is Dueling Legal in Paraguay

This aspect of the article really stinks. An example of a relevant case of a modern duel, should someone ever decide to write a better article about the duel: In 2000, the last legally recognized duel in the Netherlands (Dutch) was fought for a woman in Best, with seconds as witnesses, starting with bare hands and escalating to the murder of one of the participants by the second of the other. In 2006, in response to this case, Duell lost its legal status of being a lesser crime than murder, so no new legally recognized duels will take place. I`m sure there have been many other legitimate cases of duels in the recent past, in addition to the Latin American, French and Japanese duels in section 7 (?), which seem seriously out of place. Normally, when I visit the English Wikipedia, I expect to find additional information on a topic. That is not the case this time. 145.18.192.124 (talk) 15:28, 27 November 2009 (UTC)Reply[reply] I tried to find the exact law in the California Penal Code dealing with duels, but my search was less fruitful. All I can work on at home is an old copy of the California law of 1970 listing Title 8, Chapter 7 (which is Sections 225-232, added in 1872) in the Penal Code as the section dealing with “duels and challenges”, exactly as stated on this page. However, none of the online code searches found lists of duels, the only one I found I could search for went directly from Title 8, Chapter 6 to Title 8, Chapter 8, omitting the Duel section altogether, and I found a reference to an amendment from the 90s that seemed to delete the entire chapter. Does anyone have a more modern source on the legality of duels in California? — Previous, unsigned comment added by 68.7.247.107 (talk) 11:00, 26 June 2008 (UTC)Reply[reply] Challenging someone to a duel can be a criminal offence. Based on your IP address, I believe you live in Florida, good sir, in that case, you should be safe, since the Duel Statute (Fla.

Stat. 783) was repealed in 1972 and duels are now included in the Assault & Battery Statute. However, you may also encounter problems in the future. For example, if your challenge was to duel with someone in Kentucky, you could be barred from holding public office there. takethemud 19:40, 8 August 2006 (UTC)takethemudReply[reply] It is more than likely that the false and misleading claim that duels are legal in Paraguay stems from these earlier Uruguay laws. The factoid just got confused and changed his nationality. I questioned the accuracy of the statement about Jackson`s participation in a duel, how he “shot an opponent after the technical end of the duel.” That is not how I understood it; The duel was not over until both sides fired their weapons. In Jackson`s duel in 1806, his opponent shot Jackson before he had a chance to fire his pistol. Jackson could always shoot his own pistol if he could, and he was.

That`s how I understand the duel. If that`s what happened, then I think this passage needs to be changed in the article, since Jackson did nothing against the duel protocol and therefore did not commit murder (unless, of course, you consider duels a form of attempted murder). We really have to admit that. We have not contacted the Government of Paraguay, nor have they approached us. The Paraguayan embassy called the Mississippi Libraries Commission (MLC) and told them that there was absolutely no truth to the claim that duels are legal in Paraguay. They then informed The New York Public Library Desk Reference to follow suit. They actually confirmed that the myth cannot cite a real or true law and is indeed a complete error. This statement from the article is something I often see on this topic: “Duel is now illegal in all but a few countries in the world.” However, I have yet to see anyone who declares a country where it is legal. I suggest that this line be deleted, supported by facts and a list of nations that allow duels. 88.131.91.2 (talk) 14:15, 25 January 2008 (UTC)Reply[reply] Can anyone live with this: It is legal to fight a duel in Paraguay as long as the duels can only take place between two people, medical personnel must be available and participants must be registered blood donors.

You see up there, he calls for a complete picture with the date of institutionalization of legal status and the date of abolition. –Neurorebel (talk) 00:49, 24 June 2017 (UTC)Reply[reply] I couldn`t resist the artistic duel, so I added a quiz section. 65.255.130.104 09:09, 10. TREKphiler 15:03, 3 July 2008 (UTC)Answer[Reply] It is not possible under common law to give someone else permission to kill or injure themselves permanently. Even with the permission of the Vitim, the perpertrator will be prosecuted. Most legal systems are the same in this regard. Therefore, I think it makes sense that duels would be illegible even with the consent of both parties.

–Robertbrockway 04″33, 2 Dec 2004 (UTC) I agree that this article needs a lot of work. It is completely focused on the United States, and the history of European duels is very little mentioned, which is considerable. There is also no mention of duels in any non-Western culture. Also note that “duel” is an American spelling, this should also be included as “duel” for non-American speakers of English. There is a frequently cited but completely false claim that duels are legal in Paraguay when both parties are blood donors The laws depend somewhat on the location – this is not us.wikipedia.org! When I made a statement to the British police this year as a victim of an attack, I insisted that I had to add: “No one has my permission to fight” to cover the legal defence of martial arts as a sport, etc! I assume you mean “assisted suicide” et cetera? What about surgeon consent forms? IANAL! –(talk) 05:23, 28 December 2007 (UTC)Reply[reply] Secondly, I found a completely different approach in the book (J. Kaczmarczyk, “Bohdan Chmielnicki”, 1988). Helena married Czaplinski and was killed by Chmielnicki in 1651, so Czaplinski seduced rather than raped her. Shmielnicki, who did not have title to his Subotiv village, gave Czaplinski the opportunity to use his position and drive him out of it “in the name of the law.” It`s very different that they fought a duel.

Senate Bills 763-67 and House Bill 6135-6137 are submitted to the Governor for signature to repeal the crime of dueling. www.freep.com/article/20100613/NEWS06/6130444/1001/NEWS/Michigan-news-briefs-Dueling-prizefighting-decriminalized Dom316 (talk) 19:45, 13 June 2010 (UTC)Reply[reply] I don`t have a reference, but assuming this is true, I think it`s important not to lose this aspect of the dueling process. I found out this morning. For those of you who are too lazy to be harassed, this is a page from the Chicago Tribune with a line that says, “In Paraguay, gun duel is legal as long as both parties are registered blood donors.” Maybe in “Modern dueling” Rfwoolf 15:04, 6 August 2007 (UTC)Reply[reply] The first line adds a Western touch to the nature of the duel, which is not really present. For example, duels in Japan were so endemic that they had to be banned in the 16th century to curb the constant loss of trained warriors (see: 47 Ronin). Vendettas were sanctioned by the Japanese government before and after this period, when a warrior seeking redress had to ask permission to hunt and duel an opponent. Search the Internet for dueling laws in Paraguay. There are hundreds, if not thousands, of pages of results. It begins to appear as if the results of research on the myth were true. But each of the links points to a page that can`t provide a link to a reliable source.

This includes Wikipedia, which also listed the myth in its article on duels. This left many people wondering if this was really a real law, essentially legal, but just outdated. But this is not the first time we have discovered that Wikipedia has come up against urban legends, as we discovered with the Chinese Breast Touch Festival. I bet you`re now wondering what makes us believe that we know that this claim that duels are legal in Paraguay, assuming both parties are blood donors, is a myth? Who better to give the answer than the Paraguayan government? “Despite the romanticism of the duel in literature, the duel is an extremely dangerous practice… Tell them that I spent more time on it than was reasonable for something I quickly discovered wasn`t really an old law that was still in place.
